“A federal appeals court panel in Boston declared the Defense of Marriage Act unconstitutional on Thursday, but said that only the Supreme Court will be able settle the question of whether the federal government must recognize same-sex marriages from states where such unions are legal. A unanimous panel of the U.S. Court of Appeals for the First Circuit said the act, which was signed by President Bill Clinton and denies federal economic and other benefits for married people from same-sex couples married in states were it is legal, could not be justified under current precedents that protect minorities and other groups from discrimination.”
I suspect that if and when this goes before the Supreme Court (likely next year), the SCOTUS will strike DOMA down. The 4 liberals on the court will certainly strike it down and I can’t imagine the “swing vote” upholding it given his history. In fact, I wouldn’t be surprised if 1 or 2 of the conservatives voted to strike DOMA down. Remember, ending DOMA wouldn’t legalize gay marriage, it would just force the federal government to recognize gay marriages in states where gay marriage is legal.
Ending DOMA would be a significant, albeit largely symbolic, step towards legalizing gay marriage.
